Health and Safety Code 11379.6 makes it a felony to manufacture, compound, convert, produce, derive, process, or prepare a controlled substance, whether through chemical extraction or independent chemical synthesis. The statute reaches broadly: offering to engage in manufacturing is itself a crime, and a defendant doesn’t need to complete the process to be convicted. Knowingly participating in early or intermediate steps, while aware the substance was a controlled substance, is enough for a prosecutor to move forward.

A conviction carries a base sentence of three, five, or seven years in state prison and a fine of up to $50,000. Most manufacturing prosecutions in California involve methamphetamine produced in clandestine labs, though the statute applies across all controlled substance schedules.

Enhancements That Can Add Years to a Sentence

The base sentence is often not the ceiling. California law adds sentencing enhancements in circumstances that prosecutors in manufacturing cases frequently charge:

Proximity to a residence: Manufacturing methamphetamine within 200 feet of an occupied residence triggers an additional enhancement
Minor present: A child under 16 residing in the structure where manufacturing occurred is treated as a factor in aggravation
Large-quantity production: Manufacturing significant quantities of methamphetamine, PCP, or GHB can add years beyond the base term
Injury or death: If someone is harmed as a result of the manufacturing operation, additional time applies
